Supreme Court upheld Delhi High court order to quash CCI probe against JCB

The Supreme Court on 19th December  dismissed an appeal filed by the CCI challenging the Delhi High Court’s August 2024 decision to set aside an inquiry against UK-based JCB Limited and its Indian subsidiary over an alleged abuse of a dominant position[Competition Commission of India v. JCB India Limited and Others].

The High Court had quashed the case after the informant (Bull Machine) withdrew its complaint from the CCI following a settlement with JCB. On August 24, the Delhi High Court quashed the CCI proceedings in question as well as an order passed by a trial court issuing search warrants against JCB. The High Court passed the order after noting that the informant Bull Machine - an Indian company manufacturing tractors and tractor attachments - had withdrawn its complaint from the CCI after settling the matter with JCB.
