The Supreme Court (SC) of India has rejected the petition alleging that cab aggregators Uber and Ola are carrying out cartelization and anti-competitive practices with their algorithm-based pricing. Earlier, the Competition Commission of India (CCI) and the National Company Law Appellate Tribunal (NCLAT) too had rejected these allegations against the two companies.
Further, the SC said that "When the CCI performs inquisitorial, as opposed to adjudicatory functions, the doors of approaching the CCI and the appellate authority, i.e., the NCLAT, must be kept wide open in the public interest, so as to subserve the high public purpose of the Act”.
