CCI holds Flipkart & Amazon's business practices not in violation of Competition Act
CCI has held that the business practices of Flipkart and Amazon are not in violation of Competition Act and rejected allegations of abuse of dominant position made by All India Online Vendors Association (AIOVA) against Flipkart.
CCI held:
- Relevant market as services provided by online marketplace platforms for selling goods in India.
- No single player is commanding dominant position in the present structure of e-commerce marketplace in India.
- No violation of Section 4 of the Act. Flipkart is bound by conditions applicable to e-commerce entities, as set out in FEMA Regulations, 2017, the compliance of which is ensured by relevant authorities.
- No violation by Amazon as well.
- Any intervention in the e-commerce markets needs to be carefully crafted lest it stifles innovation.
