CCI, in another leniency decision, has granted 100% immunity from penalty to Panasonic on disclosure of cartel in dry cell batteries market. In the order, CCI held that Panasonic and Geep had indulged in anti-competitive conduct of price co-ordination, in violation of provisions of S. 3 of the Competition Act.
It was also found that a bi-lateral ancillary cartel existed between the two from October 2010 to April 2016 in the market of institutional sales of dry cell batteries.
Also, the companies, in accordance with the prices of the primary cartel (Panasonic Eveready and Indo National) used to agree on the market price of the batteries to maintain price parity in the market.
While Panasonic has been granted full immunity from penalty of INR 73.93 crores, Geep and its three officials have to pay penalty of INR 9.64 crores.
