According to sources, Bombay HC has declined to stay CCI’s anti-trust investigation into Maersk and DP World, on a petition filed by DP World Unit- Nhava Sheva International Container Terminal (NSICT).
NSICT had argued that CCI’s order was arbitrary and capricious and that the matter was outside its jurisdiction, and instead Tariff Authority for Major Ports should decide the same.
Earlier, in Nov., CCI had ordered DG to investigate a complaint by PSA International, which alleged that the cos. created entry barriers to hinder growth of PSA’s terminal by colluding on certain charges at Jawaharlal Nehru Port Trust. Higher fee was also imposed on shipping cos. for handling containers that arrived at its terminal.
Bombay HC will now hear the petition in Jan. 2019.
Meanwhile, CCI will continue its investigation in the matter.
