Madras High Court stays ban on online sales of drugs and cosmetics

The Division Bench of Madras High Court, until further orders, has stayed Single Bench judgment of ban on online sales of drugs and cosmetics. However, the direction to Govt. to notify the rules before 31 Jan. remains still in force.

The Court observed that:
  • Mechanisms are in place to prevent any abuse of process by online pharmacy sellers
  • Drugs and medicines have been sold online for a long time. Shutting down such sites will be detrimental to buyers
  • People today do not always go out and buy
  • Whether earlier writ petition is res judicata has to be argued in main appeal
  • Govt. is not opposed to it and is putting in place systems for regulating the sales
The appeals are adjourned for final hearing on 24 Jan.
