Madras HC has banned online sale of medicines holding that until Draft Rules are notified by Central Govt., the online traders are bound not to proceed with their online business in drugs and cosmetics.

The Govt. is also directed to notify Draft Drugs and Cosmetics Amendment Rules, 2018 in Gazette at the earliest, however, not later than 31.01.2019, in interests of public and online drug trade.

Thereafter, the traders have to obtain their licences, within two months from date of such notification.

Tamil Nadu Chemists and Druggists Association had filed a petition to block Indian websites, involved in online sale of Schedule H, H1 and Schedule X medicines in violation of Rules 65 and 97 of Drugs and Cosmetics Rules, 1945 till licenses are granted.

The judgment comes after Delhi HC has imposed all-India ban on online sale of medicines.
