The Ministry of Electronics and Information Technology (MeitY) has released a Draft of Information Technology [Intermediaries Guidelines (Amendment) Rules] 2018 under Section 79 of the IT Act which is meant to replace the Rules notified in 2011.

The Draft is put out for public comments till 15th Jan. 2019.

Highlights:

• Mandate cos. to trace origin of messages within 72 hrs.
• Platform to advise users against displaying/uploading harassing, blasphemous, etc. information
• Forbid users from posting content threatening unity, integrity, sovereignty of India
• Platforms with more than five mn users to have registered entity under Companies Act 2013.
• Platforms to appoint a nodal officer for coordination with agencies.
