DPIIT releases Draft National E-Commerce Policy

DPIIT has released a 42-page Draft National E-Commerce Policy, addressing six broad issues of e-commerce ecosystem i.e. data, infrastructure development, e-commerce marketplaces, regulatory issues, stimulating domestic digital economy and export promotion through e-commerce.

Highlights:

  • Regulating cross border data flows, locating computing facilities in India to ensure job creation.
  • Setting up data authority for issues of sharing of community data. 
  • Data stored abroad not to be made available to entities outside India.
  • Data not to be shared with foreign govt., without prior permission of Indian authorities.
  • FDI in marketplace model only.
  • Conditions for ecom cos. like mandatory mentioning of seller details on website for all products.
  • Financial disincentives if vendors found to be selling counterfeit products, etc.
  • Ecom cos. to not adopt business models/strategies to discriminate/favor any sellers/traders.
  • Ecom sites/apps to have a registered business entity in India.
  • Measures for sale of counterfeit products, prohibited items, and pirated content.
