Delhi HC has issued all-India ban on online sale of medicine, issuing notices to Govt. of India, Pharmacy Council of India, Central Drugs Standard Control Organisation, Drug Controller of Delhi, and Delhi Pharmacy Council.
Earlier in Oct. 2018, Madras HC had also issued all-India interim stay order on e-pharmacies.
The copy of order is yet to be uploaded on Delhi HC website.
Meanwhile, DCGI recently announced that regulations on sale of drugs by e-pharmacy [released by Dept. of Health and Family Welfare in Sept. and passed by DTAB (Drug Technical Advisory Board) in Nov.] are likely to be finalized by Dec-end.
However, the Court, in its hearing, did not go into details. It noted that online sale itself is illegal as it is not in accordance with the Act.
The matter is now listed on 25 March 2019.
